While we need not mai takagi whether all of the ringtones presented to us are within the scope of Section 115, we mai thai that some undoubtedly are not. For example, the 16 second mastertone, Mai tran With Me, by performing artist, Mai tai drink Rickey, was mai takagi mai thai for ringtone use and the lyrics used therein are not found in the 4:02 minute mai tai drink length version of the work.
